This Privacy Policy describes how Active Blend and our subsidiaries collect, use and share personal information about you and the choices that are available to you with respect to our handling of your information. This Privacy Policy applies to personal information we collect when you interact with us online (e.g., through our website or other online products and services) or offline (e.g., when you shop in our stores or interact with customer support) or otherwise interact with us described below. Our online and offline services and interactions with you are collectively referred to as "Services" in this Privacy Policy.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy and such changes will become effective upon the publication thereof on our websites. In some cases, we may provide you with additional notice such as adding a statement to the homepages of our websites or sending you an email notification.

PERSONAL INFORMATION WE COLLECT FROM YOU

We collect the following Categories of Personal Information

  • Contact Information: your first and last name, shipping address, email address, phone number;
  • Other Identifying Information: social media usernames, IP address, commerce ID, order ID, passwords and other security information for authentication and access;
  • Payment Information: name, card issuer and card type, credit or debit card number, expiration date, CVV code, and/or billing address;
  • Information you may provide about third party: name, surname, address and contact details of recipient for delivery of goods or services (such as sending a gift or virtual gift card), if different from yours;
  • Employment Information: employment status or history, or your professional information;
  • Demographic Information: age, gender and date of birth;

  • Internet or Other Electronic Activity: your browsing history, including information about how you navigate within our services and which elements of our services you use the most;

  • Commercial Information: products purchased or viewed on our websites and records and transcripts of communications with us, such as communications with our customer services team or through the chat feature on our websites;
  • Preference Information: preferences including information about the types of events and products you prefer, and physical characteristics such as your size, height, weight, or other information relevant to your apparel preferences if you voluntarily provide such information;
  • Sensitive Personal Information: in certain circumstances, we collect sensitive personal information, including precise geolocation data indicated by your mobile device or computer; and;
  • Inferences: inferences drawn from the categories described above in order to create a profile about you to reflect your preferences,characteristics, behavior and attitude.

 

What sources do we use to obtain your Personal Information?

Directly From You

We collect contact, demographic, personal preference, and payment information directly to you. You may provide us with such information through our websites, in our stores, through our customer service representatives, at events, through mobile applications, through marketing efforts, including contests, sweepstakes and events, and through third parties, or any other way we interact with you.

From Third Parties

We collect your personal information from third parties, such as social media sites, data coops and other third party data sources. We may collect your identifying information from Facebook, Pinterest and Twitter, such as your name, email address, age, gender, and location, in accordance with their terms of use and privacy policies. We may also receive demographic information about you from third party data sources to make our service and marketing efforts more efficient and personalized for you. We may also receive legal information from third parties, such as fraud checks or flags raised about your transactions, payment card refusals, suspected crimes, complaints and/or claims.

 

INFORMATION COLLECTED BY COOKIES AND SIMILAR TRACKING TECHNOLOGIES

We (and our service providers) use cookies, web beacons (also known as "tracking pixels") and similar tracking technologies to automatically collect information about you when you interact with our online Services or emails, including information about your browsing and purchasing behavior. We may derive personal information or draw inferences about you based on the other types of personal information we collect. For example, we may infer your location based on your IP address, or that you are interested in purchasing a certain type of clothing based on your browsing behavior on our Services.

SHARING OF PERSONAL INFORMATION

Where disclosure of personal information is necessary to satisfy the purpose, or a directly related purpose, for which the personal information was collected, we may share personal information about you as follows:

  • With vendors, consultants, contractors and other service providers who access personal information to carry out work on our behalf and improve the products and services they provide to us (e.g., companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, analytics, marketing and advertising);

Sharing between brands and affiliates

Public posting and social sharing

When you post public comments on our websites, through in-store technologies, on public forums like our social media sites, blogs, and online reviews, your comments are accessible by other members of the public.

Social media logins and other integrations

When you log into your customer account using your social media account credentials, or use other social media services with us, your personal information will be disclosed to the social media account provider in connection with your login. By doing so, you authorize us to facilitate this sharing of information, and you understand that this sharing is governed by the social media site’s privacy policy that you used to log into your account.

Active Blend service providers

Active Blend uses third parties to provide services to you or us. This includes managing customer information; fulfilling promotions; sending marketing communications; conducting surveys; hosting websites; analyzing data; processing payments; fulfilling and shipping orders; or providing network security, accounting, auditing, and other services. We do not authorize these service providers to use or disclose your information for purposes other than why we have retained them.

Third party partners

You may share information with other companies when we work with them to promote our products, services, offers, contests, or other promotions to our customers.

Text Marketing Notifications

By subscribing to Active Blend text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed, and that the messages may be sent via an automatic telephone dialing system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to opt-out and HELP for customer support. You may receive an additional text message confirming your decision to opt out. You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above is not a reasonable means of opting out.

 

Text Marketing Terms & Conditions

We are using a text messaging platform, which is subject to the following terms and conditions. By opting in for our text marketing and notifications, you agree to these terms and conditions.

By entering your phone number in the checkout and initializing a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. You acknowledge that consent is not a condition for any purchase.

Your phone number, name, and purchase information will be collected. This data will be used for sending you targeted marketing messages and notifications. Upon sending the text messages, your phone number will be passed to a text messages operator to fulfill their delivery.

 

If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. Script or Loyalty Programs

If you participate in third party script, loyalty, or similar programs that the Active Blend brand also participates in, we will share your information with them to facilitate the program. This may include sending your purchase information to credit card processors, so part of your purchase may be donated to participating schools or other non-profit organizations. If you participate in loyalty programs, we may send your information to the vendor administering the program. This information may include your name, email, credit card number, your purchase history, and other information you have provided to us through the program.

Once your information is provided to the third party it will be handled in accordance with their privacy policy. You should review the privacy policy before entering into a rewards, loyalty, or scrip program, so that you have a complete understanding of how your information is being used.

Payment card issuers

In certain countries, we may provide you with the opportunity to apply for an offer of credit from a payment card issuer. To create a more convenient application process, we may provide information from your customer account to a payment card issuer in order to generate a pre-approved credit offer or pre-populate your online credit card application with information from your customer account. By submitting a credit card application online, you acknowledge and agree that Active Blend may provide your information to the payment card issuer in accordance with the terms and conditions of the application. To fulfill legal obligations and with government agencies

We may share information about you if necessary or appropriate, in our good faith judgment, to comply with laws or regulations, or in response to a valid subpoena, order, or government request, or to protect the operations, privacy, safety, property or rights and Active Blend or others.

During a sale or business transaction

In the event of any potential or actual reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), your personal information may be shared with third parties such as the acquiring entity and its advisors.

Your rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Your California Privacy Rights

California Civil Code Section 1798.83 permits customers of Active Blend who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Please note that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.  This right granted to California residents applies only to their activities within the State of California. Data retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

Minors

The Site is not intended for individuals under the age of 13. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.
